General Terms and Conditions for Business, Shipping, and Use

Conclusion of the Contract of Sale

Goods, services and memberships offered on the website of the Association of Friends of the St. Florian Boys’ Choir do not represent a binding offer. A Contract of Sale is not concluded until an order is placed with obligation to pay for the goods, service or membership within the framework of the Internet offer. The supplier reserves the right to withdrawal from the contract if it has been concluded based on incorrect data (typographical errors, incorrect pricing, etc.). In this case, all payments already made will be refunded and no further claim to compensation or damages will exist. 

Terms of Payment

Payment of the agreed sale price must take place in advance, without exception. For transmission of the amount due, various options are available in the Online Shop depending on the country of destination.

Warranty, Guarantee, and Compensation for Damages

The following shall apply for consumers in accordance with the Austrian Consumer Protection Act (KSchG): The St. Florian Boys’ Choir provides the legal warranty (24 months). Defects which occur are to be reported by e-mail or telephone (+43 7224 4799) immediately after being detected. The St. Florian Boys’ Choir is liable for damages only if defects result from deliberate acts or gross negligence, with the exception of damages to persons. The compensation for consequential damages from defects and pure financial losses is ruled out in regard to companies. The existence of minor or gross negligence, insofar as the matter does not involve a consumer transaction, must be proved by the injured party.

Right to Withdraw

Consumers can, in accordance with the Austrian Consumer Protection Act (KSchG), withdraw from the sale within 14 days of receipt of the goods without specifying reasons if the acquisition took place within the framework of a distance selling transaction (e.g. online shop). 

Retention of Title

Delivered goods, services, or memberships remain the property of the Association of Friends of the St. Florian Boys’ Choir until payment of the entire agreed price of sale.

or sent by e-mail. Observance of the deadline is based on the date of dispatch.

Following written confirmation by the St. Florian Boys’ Choir, the goods are to be returned at the sender’s own cost and risk to

Refund of the purchase price minus accrued shipping costs takes place exclusively against simultaneous payment. After receipt of the return delivery, the St. Florian Boys’ Choir will undertake an inspection of the goods. The purchase price will only be refunded on the condition that the goods remain in an unused condition and are suitable for resale (e.g., CDs with cellophane intact).


Refund of the purchase price is excluded in cases of

  • Audio or video recordings which have been unsealed by the customer
  • Online services rendered
  • Concert tickets, if the concert date is in the past, even if the deadline for return delivery has been met and the ticket was not used for admission
  • Goods which were billed to third parties

Shipping Costs and Shipping Options (Status February 2019)

The following information applies to the shipping of recordings sold and purchased online. The respective shipping options must be selected as part of the order process in the Online Shop. For individual shipping arrangements, please contact us by e-mail.

Severability Clause 

If any provision of this agreement is or will be ineffective or unenforceable in whole or in part, the validity and the enforceability of its other provisions will remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable one, the economic content of which is as close as possible to the invalid or impracticable provision; the same applies to possible gaps in the contract.
